The library agrees to the following terms:

  1. the item/collection, along with all necessary copyrights in the item/collection, are owned by the library or the library has the necessary rights, whether acquired through public domain or other means, to copy and distribute electronic copies of the item/collection
  2. the library grants the right to NMRLS to hold, display, edit, reproduce, and distribute copies of the item and its description/cataloging data in electronic, print and other formats to the public in perpetuity
  3. NMRLS claims no ownership rights for the content
  4. the images created under this program are intended to serve as display copies and not as preservation copies
  5. the library staff member has attended a NMRLS digital library orientation session or agrees to attend a session prior to beginning the project
  6. NMRLS disclaims responsibility for, and the library agrees to waive responsibility against NMRLS for any direct, indirect, consequential, or incidental damages arising out of or relating to the library's use of the item/collection or NMRLS' use of the item/collection as authorized by the library
  7. The library agrees to indemnify and hold NMRLS harmless from and against all claims, expenses and liabilities, including reasonable attorneys' fees and expenses, arising out of the inaccuracy of any representation or warranty made by the library in this application, the library's breach of any of its obligations herein, or the library's negligent performance under this application
